1. Who we are
The Hey Susan service ("Susan," the "Service") — the native iOS/Android app, the web app, and the features inside them (including HeyJourney! and HeyBeNice!) — is operated by Humanoid AI Inc., doing business as Hey Susan, a British Columbia, Canada company. Contact: hi@heysusan.app.
2. What Susan is — and is not

Susan is an AI assistant for pregnancy and new-parent life. Susan is not a medical device, not a healthcare provider, not a therapist or counselor, not a childcare provider, and not a substitute for professional medical advice, diagnosis, or treatment. Information Susan provides is general information drawn from published sources; always consult your pediatrician, OB/midwife, or other qualified professional for decisions about your or your child's health. AI-generated responses can be incomplete or wrong — verify anything that matters.
3. Emergencies

Do not rely on the Service in an emergency. Call 911 (or your local emergency number) immediately. Susan attempts to recognize crisis language and surface emergency resources, but this is a best-effort safety layer, not an emergency service, and it can fail.
4. Eligibility and your account

You must be 18 years of age or older (or the age of majority in your jurisdiction, if that is older) to use the Service, and you must be a parent or caregiver using the Service to track a child in your care. You're responsible for activity under your account or chat. The Service is for your personal, non-commercial use.
5. Free access and as-is service

The Service is currently offered free of charge and on an as-is basis. Features may change, break, or be discontinued at any time. Anything described as "experimental" or "coming soon" is provided for evaluation. If we later introduce paid plans, we'll tell you clearly before you're ever charged — no surprise billing.
6. Tracking data and AI memory

You retain ownership of the information you log (feeds, sleep, milestones, messages). You grant us the limited license needed to operate the Service — to store your data, process it with our AI providers, and show it back to you and the family members you link. Our Privacy Policy describes what we store, our subprocessors, the no-training commitment, and how to delete your data. Linked family accounts share household data — link only people you intend to share with.
7. HeyBeNice! (kinder-message drafting)
📝 Plain summary (the section below is what counts): Susan rewrites your message into a kinder version. By default she hands the draft back to you — you copy and send it yourself. If you link a partner and they separately opt in, you can instead ask Susan to deliver it for you, with a tap-to-confirm step on each side.
HeyBeNice! rewrites a message you're about to send into a kinder version, with a short note on why. By default, Susan hands that draft back to you to copy and send yourself. If you have a partner linked through Family sharing, you can instead ask Susan to deliver the kinder draft to them directly — nothing is sent until you tap to confirm, and only once that person has separately given a one-time okay to receive messages this way; they can decline any message or block all future ones at any time. Outside of that opt-in, linked-partner flow, Susan does not contact anyone on your behalf. You are responsible for the messages you choose to send or have delivered. We store only numerical scores and category flags about your drafts — never the message text, other than what passes through the delivery message itself if you choose to have Susan deliver it. Not therapy, mediation, or counseling.
8. Acceptable use

You agree not to: use the Service to harass, threaten, deceive, or harm anyone; attempt to bypass safety features; probe, scrape, or reverse-engineer the Service; use it for anyone under your care without legal authority to do so; or violate any law. We may suspend or terminate accounts that do.
9. Our content and IP

The Service, its software, design, names (Hey Susan, HeyJourney!, HeyBeNice!), and content we created belong to Humanoid AI Inc. If you send feedback or suggestions, we can use them without obligation.
10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR UNINTERRUPTED AVAILABILITY, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKSWAN VENTURES INC., ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE; AND OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) USD $50 AND (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW, AND NOTHING IN THESE TERMS LIMITS NON-WAIVABLE CONSUMER RIGHTS.
12. Disputes — arbitration and class-action waiver (U.S. users); governing law

(a) Informal first. Before any formal proceeding, email hi@heysusan.app with a description of the dispute; we'll try to resolve it within 30 days.
(b) U.S. users — binding individual arbitration. If you reside in the United States, any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and you and we each waive the right to a jury trial and to participate in a class action. Small-claims court remains available for qualifying claims. Opt-out: you may opt out of this arbitration agreement by emailing hi@heysusan.app within 30 days of first accepting these Terms.
(c) Canadian and other users. These Terms are governed by the laws of British Columbia, Canada. Where local consumer-protection law gives you the right to bring claims in your local courts or limits arbitration or class waivers, nothing in these Terms takes that right away.
(d) Severability. If any part of this section is found unenforceable for a particular claim or user, the rest still applies.
13. Termination

You can stop using the Service anytime and delete your data per the Privacy Policy. We may suspend or terminate Service access for breach of these Terms or to protect users. Sections that by their nature survive (6, 9–12, 14) survive termination.
14. Changes to these Terms

We may update these Terms. For material changes we'll notify you in-product and ask you to accept the new version before continuing to use the Service. The version and effective date appear at the top of this page.
15. General
These Terms (together with the Privacy Policy) are the entire agreement between you and us about the Service; our failure to enforce a provision isn't a waiver; you may not assign these Terms; we may assign them to a successor of the business. Questions → hi@heysusan.app.
